These Terms of Service govern your access to and use of Paw Miaw, including our websites, applications, provider tools, household tools, reminders, communications, and related services (collectively, the "Service"). The Service is operated by [Paw Miaw legal entity name], currently based in Cozumel, Quintana Roo, Mexico ("Paw Miaw," "we," "us," or "our").
By creating an account, clicking to continue, accessing the Service, or using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service for a company, clinic, provider workspace, household, or other organization, you represent that you have authority to bind that organization.
1. Eligibility
You must be at least 13 years old to use Paw Miaw. If you are under the age of majority where you live, you may use the Service only with permission and supervision from a parent or legal guardian. The Service is not directed to children under 13, and you may not create an account or submit personal information if you are under 13.
2. What Paw Miaw Provides
Paw Miaw is a software platform for organizing pet care. Depending on your account and role, the Service may help you manage pet profiles, household access, care routines, appointments, provider workspaces, client records, photos, PDFs, invoices, payments, reminders, notifications, signed links, and communications.
Paw Miaw is not a veterinary clinic, hospital, pharmacy, insurer, emergency service, or medical provider. Paw Miaw does not diagnose, treat, prescribe, provide veterinary advice, guarantee provider services, or replace professional judgment. In an emergency, call a veterinarian, emergency clinic, or other qualified professional.
3. Accounts and Security
You are responsible for the accuracy of the information you provide, the security of your account credentials, and all activity under your account. Notify us promptly at support@pawmiaw.com if you believe your account has been compromised. We may require email verification, password resets, session revocation, or other security steps before allowing access to parts of the Service.
4. Household and Provider Responsibilities
Household users are responsible for the pet information, care tasks, records, photos, reminders, household invitations, provider connections, and communications they create or approve. Provider users and provider workspaces are responsible for their clinic or business profile, staff access, client records, appointment details, invoices, payments, services, treatment decisions, professional licenses, and compliance with laws that apply to their business.
When you approve a household member, provider, staff member, or signed link, you authorize the relevant access described in the product flow. You are responsible for reviewing access before granting it and for removing access when it is no longer appropriate.
5. User Content and Records
You keep ownership of content you submit to Paw Miaw, including pet profiles, messages, records, notes, photos, PDFs, attachments, appointment details, provider content, and billing information ("User Content"). You grant Paw Miaw a worldwide, non-exclusive, royalty-free license to host, store, copy, display, transmit, process, and use User Content only as needed to operate, secure, support, improve, and provide the Service.
You represent that you have the rights and permissions needed to upload and share User Content. You are responsible for keeping your own backup copies of important records. Paw Miaw is not a system of record for emergency care, legal compliance, tax compliance, or professional veterinary recordkeeping unless a separate written agreement says so.
6. Payments, Subscriptions, and Refunds
Paw Miaw may offer paid provider plans, subscriptions, add-ons, or usage-based features. Prices, plan limits, billing periods, taxes, and renewal terms will be shown at checkout or in the relevant billing flow. You authorize Paw Miaw and its payment processors to charge the payment method you provide for amounts due.
Unless required by law or stated otherwise at checkout, paid subscriptions renew automatically until canceled. You may cancel a subscription at any time, and cancellation will stop future renewals at the end of the current billing period.
Production refund policy: fees are generally non-refundable except where required by law, where we confirm a duplicate charge or billing error, or where Paw Miaw approves a refund in its discretion. Partial-month refunds and credits are not guaranteed. Purchases made through Apple App Store or Google Play must be handled through the applicable app store refund process unless the store directs otherwise.
7. Acceptable Use
You may not misuse the Service. This includes attempting to access another account without permission, interfering with security, scraping or reverse engineering the Service, uploading malicious code, sending unlawful or abusive content, violating privacy or intellectual property rights, using the Service for fraud, or using Paw Miaw to provide services you are not licensed or legally allowed to provide.
8. Third-Party Services
The Service may integrate with or depend on third-party services, including payment processors, email providers, cloud storage, authentication providers, analytics providers, app stores, and pet care providers. Third-party services may have their own terms and privacy policies. Paw Miaw is not responsible for third-party services, provider services, app store decisions, payment network decisions, or veterinary care decisions.
9. Intellectual Property
Paw Miaw and its licensors own the Service, software, design, trademarks, logos, documentation, and other materials, excluding your User Content. We grant you a limited, revocable, non-transferable license to use the Service as permitted by these Terms. Feedback you provide may be used by Paw Miaw without restriction or compensation.
10. Changes, Suspension, and Termination
We may change, suspend, or discontinue parts of the Service. We may suspend or terminate access if we believe you violated these Terms, created risk for Paw Miaw or others, failed to pay amounts due, or used the Service unlawfully. You may stop using the Service at any time and may request account deletion as described in the Privacy Policy.
11. Disclaimers
The Service is provided "as is" and "as available." To the maximum extent permitted by law, Paw Miaw disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability. We do not guarantee that reminders, notifications, messages, signed links, uploads, payment flows, or provider workflows will be error-free, uninterrupted, timely, or complete.
12. Limitation of Liability
To the maximum extent permitted by law, Paw Miaw and its owners, officers, employees, contractors, vendors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, loss of goodwill, service interruption, pet injury or death, provider conduct, veterinary decisions, billing disputes between providers and clients, or damages arising from your use of or inability to use the Service.
To the maximum extent permitted by law, Paw Miaw's total liability for any claim will be limited to the greater of the amount you paid Paw Miaw for the Service in the three months before the event giving rise to the claim or USD $100.
13. Indemnity
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Paw Miaw from claims, damages, liabilities, losses, and expenses arising from your use of the Service, your User Content, your provider or household activity, your violation of these Terms, your violation of law, or your violation of another person's rights.
14. Governing Law and Disputes
These Terms are governed by the laws of Mexico, without regard to conflict of law rules, except where consumer protection or other mandatory laws in your location require otherwise. Before filing a claim, you agree to contact us at support@pawmiaw.com and try to resolve the dispute informally. Where permitted by law, disputes will be brought in the competent courts located in Quintana Roo, Mexico, and claims must be brought individually, not as a class or representative action.
